JLAC and Asira al-Qibliya Village Council Succeed in Canceling Decision to Demolish and Block-off Al-Wadi Al-Shami Road

February 2021:  The Jerusalem Legal Aid and Human Rights Center was able, after vigorous legal followup lasting from October 2020 through mid-February 2021, to cancel a military order issued by the Israeli Military Commander of the West Bank to demolish Al-Wadi Al-Shami road, an important road for the village of Asira al-Qibliya (situated in the Nablus District).  Cutting through the village lands for decades, the road garnered the attention of the army only after recently being paved (at eh expense of villagers and a number of international donor agencies). Servicing approximately 200 dunums of lands cultivated with olives and 30 industrial and economic workshops in the area; the road is of great importance to farmers and industrial interests in the area, especially the stone industry, as it allows for the passage of trucks without having to go through the center of the village and disrupt the population and subject them to risk of accidents.  
A demolition order concerning the road was issued on October 25, 2020, under security pretexts, stipulating the immediate destruction of most of the paved parts of the road.  Immediately after learning of the decision, the village council reached out to JLAC whom were appointed to the case by the council and a number of landowners affected by the demolition decision. In record time, the legal objections and evidence were submitted, and formal, substantive and other legal defenses were raised related to the rules of international humanitarian law.  In parallel, appeals were raised to diplomatic missions, foreign and international humanitarian institutions, and the UN working in the Palestinian territory; asking for their intervention in exerting necessary political and diplomatic pressure in preventing the demolition process (i.e. reversing the decision as for it to not be renewed later), in addition to those correspondences raised to the Occupying Power. The Office of the Judicial Counselor of the Occupation Army and reported their compliance to JLAC’s appointed lawyer (Wael Abdel- Rahim Qut) on February 19, 2021, marking another successful win for JLAC in supporting the steadfastness of Palestinian communities in the face relentless violation to their human rights
